WHAT IS EMBEZZLEMENT?

Embezzlement is a white collar offense that involves theft from an employer. Theft from an employer could be in the form of:

  • Misuse of an expense account

  • Spending excessive amounts on business expenses

  • Misdirecting an employer’s funds to an unauthorized account

All forms of embezzlement in Texas are charged under the theft statute, reported to the Texas Department of Public Safety, and noted on public record.

CONSEQUENCES

Depending on the amount of funds or property embezzled, the punishment in felony cases in Texas state courts can range from two years deferred adjudication to 99 years in prison and a fine of up to $10,000. Judges may also order the re-payment of the funds embezzled, which could cause a lifelong financial burden in large embezzlement cases.

Punishment for certain embezzlement cases filed in federal court ranges from up to $100,000 for misdemeanors and up to $1,000,000 for certain felony cases. Sentencing can also include placement on probation or serving time in federal prison.
